MOUNT HOLLY — A man was sentenced to probation Friday and then freed after serving more than two years in jail in connection with the death of his girlfriend's baby and for an unrelated burglary.


At an emotional sentencing in Superior Court, the family of the infant girl expressed outrage at the dropping of a murder charge against David A. Fink, 22, and asked for more justice for the Feb. 25, 2006, incident in a Mount Laurel motel.

The court also received an Internet-based petition signed by more than 1,000 people from around the world supporting a prison sentence and the victim's family, which had circulated the petition on its Web site.

Fink was alone with the five-month-old baby and when the mother came back to the motel, she noticed the child did not appear to be well. She called 9-1-1 and the baby was taken to a hospital where she died two days later.

Superior Court Judge James Morley officially dropped the murder charge against Fink, formerly of Lumberton, at the request of assistant Burlington County prosecutor Thaddeus Drummond.

Calling it an "appropriate disposition considering all the circumstances," Drummond said medical experts for both the prosecution and defense concluded five-month-old Jasmine Fink did not die of shaken baby syndrome as originally determined at the autopsy.

The new evidence that the baby had other brain-related conditions led the county prosecutor's office to negotiate a guilty plea from Fink on March 10 to the far lesser crime of endangering the welfare of a child.

The baby, who authorities said was not Fink's biological child despite having his last name, died in a Philadelphia hospital. However, the judge said the medical examiner in that city did not have all of the medical documentation in the case when he ruled Jasmine died from shaken baby syndrome.

Morley sentenced Fink, who remained silent at the hearing, to time served in the county jail since his arrest, placed him on probation for two years and barred him from contact with the baby's family. The burglary in 2005 was at the home of an acquaintance in Pemberton Township.

"There should be a maximum sentence (life) . . . for the memory and loss of our child. . . . All I ask is that my daughter, my family and I get justice," said the baby's mother, Dawn Zoglio, who was sobbing so much that a friend had to finish reading her statement.

The judge told the Zoglio family the prosecutor would have had a difficult job convincing a jury beyond a reasonable doubt that the baby's death was a homicide.

"No one in this world can bring justice to Jasmine," the judge told them, "but now Mr. Fink will at least walk out of here knowing that his neglect or inaction allowed a child to die."

It is tragic indeed. That the person who was responsible will not have to pay any more than this. The justice system is far less than perfect. My prayer for you and your family is that you can now begin to move forward.... to put the peices back together... to heal with God's Strength...and to come to forgive with the help of God's mercy.

Wow- So Sorry Mary.

Our situation was neglegence on a few levels. The main being- there was a forein substance on the road. My Hubby & sons were the 3rd accident that day- The state (road crew) was called in early that day. & Never addressed it- Then the jerks had the nerve to bill us for the sand they dumped on the road after the accident & for help with traffic control.
How are we to accept such neglegnce & they never even miss a step let alone have to serve time or pay. It is hard to have faith in the legal system & laws.

This coming week, we will learn if the boy who was driving the car that Christopher was in when the accident occurred. It isn't so clear - another woman turned left in front of him, but the driver was going more than 30 MPH over the speed limit. Please pray for wisdom for those making decisions and for peace for me as well as the other family who lost their mother.
